This Privacy Policy describes how Pinnacle Performance CA LLC ("Company," "we," "us," or "our"), the operator of conorharris.com (the "Site"), collects, uses, shares, and protects your personal information when you visit the Site, purchase our programs, enroll in our certification offerings, or otherwise interact with our services (collectively, the "Services").

Our Services include digital movement education programs such as Beginner Body Restoration, Symmetric Strength, Lower Limb Foundations, No B.S. Guide to Shoulder Health, Own Your Body, and Biomechanics Blueprint, as well as our professional certification offering, the Biomechanics Program, and related coaching, community, and educational content.

By accessing or using the Services, you agree to the collection and use of your information as described in this Privacy Policy. If you do not agree with this Policy, please do not use the Services.

2. Information We Collect

2.1 Information You Provide Directly

  • Contact and account information. Name, email address, phone number, and billing address when you create an account, make a purchase, book a call, or subscribe to our email list.
  • Payment information. Payment card details and transaction history, processed securely by our payment processors. We do not store full payment card numbers on our own systems.
  • Survey and application responses. Information you share when completing intake surveys, applications, or questionnaires, such as your movement goals, training background, areas of tightness or discomfort you want to address, and professional credentials if you apply to the Biomechanics Program.
  • Communications. Messages you send us by email, contact forms, direct messages on social platforms, chat tools, or during scheduled calls.
  • User content. Reviews, testimonials, community posts, and other content you choose to submit.

2.2 Information Collected Automatically

  • Device and usage data. IP address, browser type, device identifiers, operating system, and referral URLs.
  • Site activity. Pages viewed, time on page, clicks, video engagement, course progress, and purchase funnel activity.
  • Cookies and tracking data. Data collected through cookies, pixels, and similar technologies as described in Section 5.

2.3 Information from Third Parties

We may receive information about you from third party platforms you interact with, including social media platforms (such as Instagram and YouTube), scheduling tools, advertising partners, and analytics providers, consistent with their own privacy policies and your settings on those platforms.

6.1 Service Providers

We share information with third party providers who perform services on our behalf, under agreements limiting their use of your data. These currently include:

  • Course and site platform. Kajabi, which hosts our courses, checkout pages, and member areas.
  • Payment processing. Stripe and PayPal, which handle payment transactions.
  • Customer relationship management. GoHighLevel, which manages our contact records, funnels, email and SMS communications, and pipelines.
  • Scheduling. Calendly and related booking tools used to schedule calls.
  • Messaging and support. ManyChat, Zendesk, and automation tools such as Make.com used to respond to messages and route inquiries.
  • Analytics and advertising. Google Analytics, Meta (Facebook and Instagram), and YouTube, used for measurement and advertising as described above.

6.2 Legal and Safety

We may disclose information when required by law, subpoena, or other legal process, or when we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud.

6.3 Business Transfers

If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any change in ownership or use of your personal information.

6.4 With Your Consent

We may share information for other purposes with your consent, such as publishing a testimonial you have approved.

7. Your Privacy Rights

8. California Privacy Rights (CCPA and CPRA)

If you are a California resident, the California Consumer Privacy Act as amended by the California Privacy Rights Act gives you specific rights, including the right to know what categories of personal information we collect and how we use them, the right to delete personal information, the right to correct inaccurate personal information, the right to opt out of the "sale" or "sharing" of personal information as those terms are defined by California law, and the right to limit the use of sensitive personal information.

Our use of advertising pixels and similar technologies may be considered "sharing" for cross context behavioral advertising under California law. You may opt out of this sharing by adjusting your cookie settings, using the opt out mechanisms described in Section 5, or contacting us directly. We do not knowingly sell or share the personal information of consumers under 16 years of age.

In the preceding 12 months, we have collected the categories of personal information described in Section 2: identifiers, commercial information, internet activity, and inferences drawn from that information. We collect these categories from the sources and for the purposes described in Sections 2 and 3, and we disclose them to the service providers described in Section 6.

9. International Users and Data Transfers

We are based in the United States, and your information will be processed and stored in the United States and in other countries where our service providers operate. These countries may have data protection laws different from those in your country. Where required, we rely on appropriate safeguards for international transfers, such as Standard Contractual Clauses approved by the European Commission.

10. Data Retention

We retain personal information for as long as needed to provide the Services and for legitimate business purposes, such as maintaining your course access, complying with tax and accounting obligations, resolving disputes, and enforcing agreements. As a general guide: account and purchase records are kept for the life of your account plus up to seven years for tax and legal purposes; marketing data is kept until you unsubscribe or request deletion; and analytics data is retained according to the settings of the relevant analytics tools. When information is no longer needed, we delete or de identify it.

11. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect your personal information, including encryption in transit, access controls, and reliance on established platforms with strong security practices. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account password confidential.

12. Children's Privacy

The Services are intended for adults 18 years of age and older. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of anyone under 16. If you believe a child has provided us personal information, contact us and we will delete it.

13. Email, SMS, and Marketing Communications

If you opt in to our email list or SMS messages, we will send you educational content, program information, and promotional offers. Every marketing email includes an unsubscribe link, and you can opt out of SMS messages by replying STOP. Opting out of marketing does not affect transactional messages such as receipts, account notices, and program delivery emails. We comply with the CAN SPAM Act and the Telephone Consumer Protection Act.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page, and for material changes we will provide additional notice such as an email or a prominent notice on the Site. Your continued use of the Services after changes take effect constitutes acceptance of the updated Policy.
